ECDR RULES ON ACCREDITATION AND KEEPING OF THE REGISTER OF ARBITRATORS, MEDIATORS, NEUTRAL EVALUATORS AND OTHER EXPERTS FOR DISPUTE RESOLUTION

 

 

 

CONDITIONS FOR ACCREDITATION AND REGISTRATION

 

Associated member mediator:

-        Successfully concluded 40-hours initial training program for mediators at ECDR or any other national or international training program recognized by ECDR;

-        Less than 2 years practical experience in the field of dispute resolution.

 

Accredited member mediator:

-        Successfully concluded 40-hours initial training program for mediators at ECDR or any other national or international training program recognized by ECDR;

-        At least 2 years practical experience in the field of dispute resolution.

 

Associated member arbiter:

-        Judge (active, retired or former judge at national, foreign or international court, tribunal or arbitration), attorney, law professor or other expert;

-        Less than 2 years practical experience in the field of dispute resolution.

 

Accredited member arbiter:

-        Judge (active, retired or former judge at national, foreign or international court, tribunal or arbitration), attorney, law professor or other expert;

-        At least 2 years practical experience in the field of dispute resolution.

 

Honorary member mediator or arbitrator:

High professional reputation gained in Slovenia or/and abroad through many years of dispute resolution practice.

 

Approved selected expert:

National or foreign mediator, arbitrator or expert not accredited with ECDR, selected upon the agreement of all the parties of the dispute and approved by ECDR.

 

COMMITMENT TO ACT IN ACCORDANCE WITH ETHICAL STANDARDS

 

All neutrals cooperating with ECDR are bound to act in compliance with ECDR Code od ethical standards of professional responsibility. Appeals with respect to the breach of Code of ethical standards are being reviewed by the ECDR Council for ethical questions. Should such a breach be determined the Council may issue a warning or recommend to the director of ECDR the withdrawal of the accreditation and striking of the neutral from the register of neutrals. Rules and procedures with respect to determination of breach of ethical standards are defined with the Rules of procedure adopted by the ECDR Council for ethical questions.

 

DURATION AND RENEW OF ACCREDITATION

 

ECDR`s accreditation is valid for two years and is renewable on the basis of the preliminary examination of successfulness and effectiveness in the provision of services for which the accredited member is accredited.

 

Mediators` accreditation could be renewed upon fulfilled conditions from previous paragraph and upon submission of certificate of completed at least 16-hour training program, which is recognized by the ECDR.

 

Discretionary decision on accreditation and registration or its renewal based on submitted evidence and completed application ECDR form, is adopted by the director of ECDR.

 

With a permanent appointment, honorary member obtains the right to accreditation.

 

 

REGISTER OF ACCREDITED EXPERTS

 

The register of accredited neutrals administered by ECDR contains the following information:

-        personal name and surname of the expert,

-        academic or professional title,

-        types of disputes for which the expert is specialized

-        a brief description of professional experience.
